Terms of the SPEKTRA referral programme
Last updated: 19 September 2026
This is a translation for your convenience. SPEKTRA is an Austrian sole proprietorship and our contracts are governed by Austrian law. Where this English text and the German original differ, the German version prevails — you can read it any time by switching the language at the top of the page. Nothing here is meant to say anything different from the German text; if you spot a discrepancy, tell us and we will fix the translation.
Version 2026-09-19. These terms apply in addition to SPEKTRA's general terms and privacy notice.
1. Organiser and scope
The referral programme (the “programme”) is run by SPEKTRA — Raul Tatzber, Feldgasse 70/3, 2232 Deutsch-Wagram, Austria (“SPEKTRA”). These terms govern the relationship between SPEKTRA and everyone who takes part (“partners”). Orders placed by referred customers are governed by SPEKTRA's general terms.
2. Who can take part
Anyone aged 18 or over with a SPEKTRA account can take part; businesses take part through a person authorised to represent them. Taking part is voluntary and free of charge and can be ended at any time. By signing up, the partner confirms that they are of age and accepts these terms; SPEKTRA records the time and the version accepted. There is no entitlement to take part; SPEKTRA may decline a sign-up for an objective reason.
3. How it works
Every partner receives a personal referral code, a referral link and a QR code. If they recommend SPEKTRA to someone who then redeems the code — through the link, or by entering it in their account or during checkout — the code is saved to that person's account and applies to their first order of a website package.
Only someone who has not yet ordered a website package from SPEKTRA (cancelled orders excepted) counts as referred — a “new customer”. Exactly one code applies per new customer: the code saved to the new customer's account at the time of ordering. Until they order, the new customer may change or remove the code. A partner cannot redeem their own code.
4. Reward
The partner receives a one-off reward per new customer:
- Basic website package: € 50
- Standard website package: € 100
- Premium website package: € 150
The reward becomes due once the new customer has paid for the website package in full and a waiting period of 14 days has then passed (during which the new customer can still withdraw from or unwind the contract). It does not arise if the order is cancelled, if the new customer does not take the package at hand-over (satisfaction rule, general terms point 3), if a right of withdrawal is exercised, if the payment for the website package is refunded or charged back in full before the reward is paid out (regardless of the status of any care plan), if the partner used their own code, or if point 7 was breached. Other services (add-ons, care plans, AI chatbot, website update) do not give rise to a reward.
The reward is a gross amount. If the partner is a business registered for VAT, it is understood to include any VAT.
5. Payout
SPEKTRA pays the reward within 7 days of it becoming due, in the way the partner chooses in their partner account: (a) by bank transfer to the IBAN given there or (b) as credit that SPEKTRA sets off against invoices to the partner; unused credit is transferred on request. Cash payouts are excluded. Giving bank details is optional. If a transfer is chosen but no bank details have been given yet, the reward is held until the partner adds them or chooses another method.
If the details suggest that the partner and the new customer are the same person or the same business (for example the same name, the same phone number, the same mailbox or the same company email domain), SPEKTRA checks the referral before paying out and may ask for a short confirmation or proof; the payout period then starts when this check is complete. If the partner changes their bank details, they receive a confirmation by email; if the details were changed shortly before a payout, SPEKTRA may confirm the change with the partner first.
If a reward that is due has not arrived after 7 days, please get in touch — through the partner account or at raultatzber@spektra-sites.com — quoting the referral number; SPEKTRA will sort it out promptly. SPEKTRA is not liable for misdirected transfers caused by incorrect details given by the partner. Claims do not lapse before the statutory limitation period expires.
6. Benefit for new customers
New customers receive a 15% discount on the price of the website package in their first order (Basic or Standard; for Premium, 15% off the package price stated in the quote). The discount does not apply to add-ons, the photo & video shoot, care plans, the AI chatbot or the website update. In addition, the first two months of the first care plan that starts with this website package are free instead of the usual first month; after that the regular price applies, cancellable under the general terms. The benefit cannot be combined with other discounts or offers, cannot be exchanged for cash and does not apply retroactively to orders already placed. New customers are told on the referral page that the partner receives a reward if they buy.
7. Rules for recommending
The partner undertakes
- not to send promotional messages by email, text or messenger to anyone who has not agreed to them beforehand, not to make promotional calls and not to use bought or harvested address lists (§ 174 of the Austrian Telecommunications Act 2021); personal recommendations to people they know are of course allowed;
- to label public recommendations (for example on social media, a website, in a video or blog) clearly as “advertising” (“Werbung”/“Anzeige”) and to disclose that they receive a reward for a referral (§ 26 of the Austrian Media Act, § 6 of the E-Commerce Act);
- to say only true things about SPEKTRA and not to promise anything SPEKTRA does not offer (such as a “free website”), not to pressure anyone and not to exploit any dependency;
- not to give the impression of acting on behalf of SPEKTRA, and not to use the name SPEKTRA for their own paid advertisements (such as search ads);
- not to create fake accounts or refer themselves.
If these rules are breached, SPEKTRA may refuse the reward for the referrals concerned, block the code and end the partner's participation; rewards paid wrongly must be repaid. Further statutory claims remain unaffected.
8. No agency
The partner recommends independently and does not act on behalf of SPEKTRA. They may not conclude contracts for SPEKTRA, make commitments or accept payments; the new customer places the order directly with SPEKTRA. Taking part does not create a commercial agency, employment or service relationship. There is no obligation to recommend, no minimum number and no exclusive territory.
9. Tax
Rewards may be subject to income tax. Under § 29 (3) of the Austrian Income Tax Act, income from occasional referrals is tax-free if it totals no more than € 220 in a calendar year; above that, the partner declares it in their own tax return. Anyone who refers regularly or commercially is responsible for any trade licence, tax and social insurance themselves. If payments to a partner exceed € 900 in a calendar year, SPEKTRA may be required to report them to the tax office (§ 109a of the Income Tax Act); above that limit, SPEKTRA therefore pays out only once the partner has given their address and date of birth in the partner account. The partner account points out both limits but is not tax advice.
10. Data protection
How SPEKTRA processes partners' data is set out in the privacy notice. The partner receives no personal data about new customers: for each referral the partner account shows only its number, status, date and reward — never names or order details. SPEKTRA does not send invitations or promotional messages to anyone a partner names.
11. Duration, changes and ending
The programme runs indefinitely. The partner may end their participation at any time. SPEKTRA may end the programme or change these terms with 30 days' notice; changes apply to new customers who order after they take effect and are announced in the partner account. In cases of abuse, SPEKTRA may end participation immediately. Rewards already earned remain payable in every case. If the partner deletes their account, participation ends; rewards already due are still paid — the partner gives a payout method before deleting, or gets in touch afterwards quoting the referral number.
12. Liability
SPEKTRA is not liable for slight negligence; this does not apply to personal injury. SPEKTRA gives no guarantee against temporary technical faults (for example when opening a link); a referral not recorded because of one is assigned afterwards on the partner's notice if it can be verified.
13. Law and jurisdiction
Austrian law applies, excluding the conflict-of-laws rules of private international law. If the partner is a consumer, mandatory protective provisions of the state of their habitual residence remain unaffected, and jurisdiction follows § 14 of the Austrian Consumer Protection Act. If the partner is a business, the court with subject-matter jurisdiction for 2232 Deutsch-Wagram has jurisdiction.
