Terms and conditions
Last updated: September 2026 · Version 2026-09-30
This is a translation for your convenience. SPEKTRA is an Austrian sole proprietorship and our contracts are governed by Austrian law. Where this English text and the German original differ, the German version prevails — you can read it any time by switching the language at the top of the page. Nothing here is meant to say anything different from the German text; if you spot a discrepancy, tell us and we will fix the translation.
1. Scope
These terms apply to every contract between SPEKTRA — Raul Tatzber (“SPEKTRA”) and customers concerning web design and web development: website packages, add-ons, one-off website updates and ongoing care plans, whether ordered through spektra-sites.com or agreed individually.
2. What we provide
What each package, add-on and care plan includes follows from the description published on spektra-sites.com at the time you order. Premium projects are agreed individually after a conversation and a written specification; they start once that is agreed and the agreed deposit has been received.
The AI chatbot, Mira and the website update can also be ordered on their own, without a new website package — in each case only for a website created and operated by SPEKTRA (see point 8b). Since 22 Sep 2026 these services are no longer offered for third-party websites. All other add-ons (the SEO boost, express delivery, additional pages, a second language and the photo & video shoot) require a website package. SPEKTRA offers the on-site photo & video shoot only within 25 km (as the crow flies) of Deutsch-Wagram; outside that radius, the customer provides their own photo and video material, which SPEKTRA builds into the website. SPEKTRA does not offer logo design; an existing logo is built in.
2a. How ordering works and when the contract is formed
For orders placed through the order flow on spektra-sites.com (website packages, add-ons, the website update and care plans): you choose the service you want, for example on the pricing page, and go through the steps of the order flow — depending on the service, extras, details about your project, how you would like to be contacted, or the care plan. Throughout, the “Your order” summary shows every item you have selected with its price, and the total. In the last step you accept these terms and send the order with the “Order with obligation to pay” button (for a care plan on its own: “Subscribe with obligation to pay”). If you are not signed in yet, you are first taken to sign in or register; your selection is kept, and nothing is sent until you press the button afterwards.
Until you send the order you can check every entry and correct input errors: “Back” takes you to earlier steps, where you change your selection and details directly, and the summary shows each change straight away. Only by clicking “Order with obligation to pay” or “Subscribe with obligation to pay” do you make a binding offer. The contract is formed by our order confirmation by email. For a care plan on its own paid online, the click takes you to Stripe to store your payment method; the order confirmation follows once that is complete.
We store the contract text — every item ordered, with its price. You find it in the order confirmation and, for as long as your account exists, in your account under “Orders”. You can open, save and print these terms on this page at any time. The contract languages are German and English; the German version prevails. Premium projects are not agreed through this order flow but commissioned individually as described in point 2.
3. Prices and payment
One-off project work (website packages, add-ons, website updates) and recurring monthly services (hosting, Website Care, Website Growth) are invoiced separately. All prices are in euros. For orders placed on the website, the only items paid in full when booked, instead of “built first, paid later”, are the on-site photo & video shoot and the AI update (point 8b); the setup of a separately booked chatbot is paid when it goes live, after you have tried it free of charge. The shoot is paid in advance because SPEKTRA travels to an agreed date for it. It can be cancelled free of charge up to 48 hours before the agreed date, in which case the amount paid is refunded in full. For a later cancellation SPEKTRA keeps the agreed amount less what is saved by the shoot not taking place (in particular travel and material costs) — § 1168 ABGB. Statutory rights, in particular the right of withdrawal under point 10, remain unaffected. Premium projects start with a deposit (see below in this point); AI credit is topped up in advance (point 8b).
Referral discount: Anyone who has a valid referral code saved to their account when they first order a website package receives a 15% discount on the price of that package (Basic or Standard; for Premium, on the package price in the quote) and, for the first care plan that starts with that package, the first two months free instead of the first. The discount does not apply to add-ons, the photo & video shoot, care plans, the AI chatbot or the website update, cannot be combined with other discounts and cannot be exchanged for cash. See the referral programme terms for details.
One-time discount when cancelling: If you choose the reason “too expensive” while cancelling the Express request, you can secure a one-time 30% discount — it is secured once you then send the request. The discount applies to the price of the website package (Basic or Standard) of your first website order, once per person and business, to new customers only and for 60 days from sending the request. It is tied to your account, cannot be transferred or exchanged for cash, does not apply to extras (e.g. AI chatbot, Mira, SEO boost, photo & video shoot), care plans or the website update, and cannot be combined with the referral discount — only one applies at a time. Winter prices for extras apply independently of it. If the order is cancelled without payment, or the discounted website package is declined at the decision, the discount becomes available again until the 60 days run out. A displayed offer that is not secured immediately expires; there is no entitlement to a further offer.
VAT: SPEKTRA is a small business exempt from VAT under § 6 (1) 27 of the Austrian VAT Act. No VAT is charged and none is shown on invoices. Every price quoted is the final price — nothing is added. Input tax cannot be deducted from these invoices.
You pay only if you like it — nothing up front: For Basic and Standard website projects, the add-ons ordered with them (except the photo shoot), the website update and the separately booked setup of the chatbot and Mira, no payment obligation arises before the website is finished and shown to you. The only thing that matters is whether you like it — there is no objective standard SPEKTRA could hold against you, and you do not have to justify your answer.
If you do not like it: No payment obligation arises. The website is not published, and you receive no files, no source code and no rights of use. All rights in the design remain with SPEKTRA, and the work may be shown as a reference in line with the separate agreement. Nothing is charged — but nothing is handed over either.
If you do like it: Once you declare that you like the website, the agreed fixed price becomes due. Any monthly care plan ordered alongside it starts from that moment too. You can pay online through the payment provider Stripe, by invoice, or in person by card (via SumUp).
Where this does not apply: Care plans are available only for websites built by SPEKTRA. If you take out a plan after buying the website, it starts when you take it out; the first month is free in that case too (for a first order through the referral programme, the first two months — see below). Premium projects start with a deposit; the satisfaction rule does not apply to them, because the effort involved cannot be estimated in advance. Their scope is agreed separately.
Its limit: It covers the result we delivered, not a brief that changed afterwards. If you want something substantially different once the work is finished, that is a new project.
Payment requests by link: For work that has fallen due, SPEKTRA may send a payment request containing a personal payment link. That link is meant for the recipient alone and should not be passed on. You do not need an account on this website to use it. Only the amount named in the request can be paid through it.
Recurring payments: For monthly services, a payment method (card or SEPA direct debit) is stored with Stripe and the agreed amount is collected monthly in advance. An invoice is emailed for every collection. If a collection fails it is retried automatically several times; you are told about it and can update your payment method yourself at any time. A SEPA direct debit mandate is granted during the Stripe payment flow and can be revoked at any time.
Late payment: If you fall into arrears, the statutory rules apply. Businesses are charged default interest under § 456 of the Austrian Commercial Code; consumers are charged the statutory 4 % per annum under § 1000 of the Austrian Civil Code.
4. Term and cancellation of care plans
Care plans are taken out per website and require a website built by SPEKTRA. They run for an indefinite term, are billed monthly and can be cancelled at any time — online in your account or in writing — with effect from the end of the current billing period. Periods already billed are not refunded. You can switch plans online at any time; the switch takes effect at the end of the current billing period, without pro-rata charges. SPEKTRA publishes and hosts a website only while a care plan is running. If you would rather host the website yourself, you receive the source code once it has been paid for in full (section 8a).
5. What we need from you
Content we need in order to build (texts, logos, images, business details) has to reach us in good time. You warrant that you hold the necessary rights to everything you supply. If a third party brings a claim against SPEKTRA because of such content, you indemnify SPEKTRA to the extent that you are responsible for the infringement; SPEKTRA tells you without delay and gives you the chance to defend the claim yourself. For business customers the indemnity applies regardless of fault.
6. What is not included
- SEO is optimisation work — no specific search engine ranking is guaranteed.
- Under Care or Growth, the customer changes their website themselves through the workshop (section 8e) — the monthly workshop credit is not an unlimited revision service. Only care plans concluded before 27 September 2026 additionally keep one clearly bounded change per month that SPEKTRA carries out by hand (grandfathering, section 8e). If the workshop isn't enough or the customer gets stuck, help is offered as a separate, separately-commissioned service — SPEKTRA states a fixed price beforehand (usually the website update) or an individual quote; nothing is billed before it has been expressly commissioned.
- Third-party costs (APIs, booking tools, premium plugins, SaaS services) are not automatically included.
- The domain is registered in your name and you carry its running cost. SPEKTRA handles the setup.
- Larger rebuilds, extra pages or new features are quoted separately and openly, before anything happens.
7. Completion and feedback
Drafts are agreed together, and feedback within the agreed package scope goes into the build. The finished website is shown on a preview address that is not publicly advertised.
A payment obligation arises only through your express declaration in your account that you like the website, through payment via the payment link, or by the site being published on your own domain. Merely looking at the preview, staying silent, or letting time pass creates no obligation to pay.
8. Rights of use
Rights of use arise only on full payment. Until then every right in the design stays with SPEKTRA — including where the site has already been visible on a preview address. On full payment you receive the unlimited right, in time and territory, to use the website created for your own web presence. General tools, libraries and reusable components remain with SPEKTRA or their respective licensors.
8a. Source code and hosting
Whether you receive the source code depends on who hosts the website. If you host it yourself, the source code is handed over; without an ongoing care plan from SPEKTRA, the project then belongs to you alone.
If SPEKTRA hosts the website, the source code is not handed over. In that case, SPEKTRA takes care of operation and maintenance to the agreed extent; the reason for withholding it is that the safeguards in use should not be altered by anyone else.
If the care plan ends — through cancellation under § 4, or because SPEKTRA is no longer able to continue it — the customer receives the source code once the billing period under § 4 has ended. Where SPEKTRA hosted the website, it is taken offline at that point. The related safeguards in SPEKTRA's products end, and no further services are provided. What happens to the website after that is for the customer alone to decide.
8b. AI chatbot and Mira: setup and credit
Requirement: the AI chatbot and Mira are offered only for a website created and operated by SPEKTRA. No embed code and no call forwarding is provided for third-party websites; on a website SPEKTRA does not operate, neither availability and security nor compliance with the disclosure duties under Art. 50 of Regulation (EU) 2024/1689 can be ensured.
Setup: € 149,99 once per bot, or € 179,99 for Mira; if the service is ordered together with a website, the setup is part of that order. The customer sets up the bot in their account (with the setup assistant, if they like) and is responsible for the content provided, in particular the knowledge about their own business.
Running cost: since 22 Sep 2026 there is no monthly fee for the AI chatbot or Mira. The former AI plan (€35.99 per month per account) is no longer offered and is no longer a condition for the bots to answer. AI plans already entered into continue unchanged until the customer cancels them in their account; cancellation takes effect at the end of the current period and does not affect the operation of the bots.
Credit: the customer tops up credit (€10 to €1,000 per top-up); the amount paid is credited 1:1, and no fee is charged for topping up. The customer decides how much to top up and when; there is no minimum top-up per month. The AI chatbot and Mira bill from the same credit on the same account. Every answer from a bot is deducted from the credit at the list price of the AI model used plus 27% (a 24% operating surcharge for operation, procurement and billing, and a 3% safety buffer); for Mira, billing is per second of conversation rather than per answer (point 8d), and the same rules otherwise apply. Prices in US dollars are counted 1:1 in euros. Before each answer, the highest possible amount for it is set aside; if the credit does not cover it, the bot does not answer. The daily breakdown is in the account, and a monthly overview is also sent by email. The customer is informed by email once 80% of the credit available after the last top-up has been used, and when it is used up. Once the credit is used up or the self-chosen daily limit is reached, the bot stops answering until credit is available again or the next day begins. Credit does not expire. Unused credit is refunded on request after the end of the contract. The surcharge is part of the price per answer and does not depend on the payment method chosen; no payment-instrument surcharge within the meaning of § 56 (3) of the Austrian Payment Services Act 2018 is charged.
AI update: on request, SPEKTRA changes the knowledge, texts, colours and design of an existing bot according to the customer's instructions in one pass. The fee is €89 per order, payable when booking. Larger rebuilds are quoted separately beforehand. If a consumer expressly asks us to begin before the withdrawal period ends, the right of withdrawal lapses once the update has been carried out in full (§ 18 (1) 1 FAGG); without that request, SPEKTRA begins only after the period has expired.
Requirement, embedding and answers: the chatbot and Mira require a website that SPEKTRA has built and operates for the customer; they are not offered for third-party websites. SPEKTRA does the embedding itself when the site goes live; the customer installs nothing. The bot only appears on the domains entered in the account. Answers are generated by an AI model based on the knowledge provided; they can be wrong. The bot makes no binding commitment beyond that knowledge and books nothing. The chat window tells visitors that they are talking to an AI (Art. 50 AI Act). SPEKTRA may temporarily suspend a bot if it is used unlawfully or its operation is at risk, for example through automated mass requests, and informs the customer.
Visitors' messages are governed by the data processing agreement, which the customer enters into before a bot goes live for the first time.
8e. Workshop — changes made with AI
Customers with a website created and operated by SPEKTRA can describe changes to their website in their account; an AI system implements them, checks them for obvious legal and security problems and provides a preview. Publishing is done solely by the customer. SPEKTRA owes the provision of the tool, not a particular result; a request may be declined, returned with a question, or referred to a larger package or an add-on.
Scope: what the purchased package includes can be changed (content, images, videos, entries, order, design). Features of a larger package or add-ons (e.g. enquiry forms, bookings, payments, chatbot, second language, additional pages) are not built via the workshop but ordered separately: from Basic to Standard for the price difference shown on the pricing page; Premium by individual agreement; add-ons at their respective price. Legal texts, configuration and security layers of the website are not changed by the workshop.
Credit: running care plans include a monthly editing credit as shown on the pricing page (currently Care €3, Growth €6); the Hosting plan does not get a monthly credit, but the workshop can still be used there with topped-up credit. The monthly credit is refilled to the stated amount at the start of every calendar month; any monthly credit from the previous month that was not used lapses at that point and does not accumulate. Usage is deducted from the monthly credit first and only then from topped-up credit. For care plans concluded before 27 September 2026 the amounts agreed at the time (Care €10, Growth €20) continue to apply without monthly lapse. Additional credit can be topped up at any time (€5 to €500 per top-up, credited 1:1, no top-up fee, final price without VAT — small-business exemption). Every edit is deducted from the credit at the list price of the AI model used plus 27% (a 24% operating surcharge and a 3% safety buffer) — the same surcharge as for the chatbot and Mira; but at most €1 per edit. A small change is expected to cost mostly between €0.15 and €0.30; larger ones cost correspondingly more. The deduction also applies where the edit comes back with a question or is discarded by the customer — the computing time is used up in those cases. Nothing is deducted where the edit fails through a technical fault on SPEKTRA's side, or where SPEKTRA declines the request or refers it to a larger package or an add-on. Topped-up credit does not expire and is refunded on request once the contract ends. Monthly credit is part of the care plan, is not paid for separately, lapses at the latest 90 days after the plan ends and is not paid out.
Responsibility: the customer is responsible for the content they commission and publish (accuracy of information and prices, rights to images and texts). The automatic check is a support and not legal advice; it may miss errors. SPEKTRA may decline obviously unlawful changes and withdraw already published changes upon becoming aware of them (see 8c). Every publication is logged with time and wording of the request (see privacy policy, section 7j).
Data protection: if the website contains personal data of third parties (such as staff), SPEKTRA processes it for changes in the workshop as a processor under the data processing agreement; it applies from the first commissioned change.
8c. Content on hosted websites and chatbots
The customer is responsible for the content of their website and the knowledge of their chatbots and ensures that this content infringes neither applicable law nor the rights of third parties. Where SPEKTRA hosts websites or chatbots, SPEKTRA is a hosting service provider within the meaning of Regulation (EU) 2022/2065 (Digital Services Act).
Anyone can report illegal content electronically to the point of contact named in the legal notice (Art. 16 DSA). SPEKTRA acknowledges receipt, reviews every report promptly, diligently and objectively and informs the reporting person of its decision. If content is manifestly illegal, SPEKTRA may block access to that content or, where this is not otherwise possible, to the website or chatbot concerned until the problem has been fixed.
SPEKTRA informs the customer of any restriction without delay and gives reasons (Art. 17 DSA). The customer can object by email at any time; a human decides on the objection. SPEKTRA does not use automated means for such decisions. The right to go to court or to the competent authority remains unaffected.
8d. Mira: setup, credit and the limits of her authority
As long as Mira is marked „in development“ on her product page, an order is a pre-order: setup is only charged once Mira is switched on for the customer. Until then, the pre-order can be cancelled free of charge at any time.
Setup and credit: setup is charged at the one-off fee stated on the Mira product page at the time of the order; if Mira is ordered together with a website, setup is part of that order. Since 22 Sep 2026 there is no monthly fee (section 8b). After setup the customer pays only credit they top up themselves (€10 to €1,000 per top-up, credited 1:1, no top-up fee) — the same credit the AI chatbot bills from. Without enough credit, Mira does not take calls.
Every second of a call is deducted from the credit on the same account at the purchase price of speech recognition, language model, voice output and — once Mira is connected to a phone number — telephony, plus 27% (the same surcharge as the AI chatbot: a 24% operating surcharge, a 3% safety buffer). Before each call, the highest possible amount for it is set aside; if the credit does not cover it, Mira does not take the call. The cost range on the product page is an estimate for guidance, not a promise — you are billed for what is actually used. Credit does not expire and is refunded on request once the contract ends.
Mira is an automated system that speaks with callers on the customer's behalf. She names only the services, prices and times the customer has entered themselves, does not negotiate, and makes no binding commitment — in particular no appointment guarantees, no discounts, no contracts. The only thing a call can produce is a proposed callback appointment; whether and how the customer follows up is for the customer to decide. SPEKTRA thereby takes on no authority to make legally binding statements on the customer's behalf, and Mira is not designed to make any.
No promise is made about round-the-clock reachability, recognition accuracy for every dialect or accent, or the continuous, uninterrupted availability of the voice services used (section 9 applies accordingly). Misrecognitions can happen; SPEKTRA keeps improving recognition but does not promise a specific result.
The public demo on spektra-sites.com is not a contractual offer: it is limited to one call per visitor per day, capped overall, and can be restricted or switched off at any time without notice.
Mira tells callers in the first sentence of every call that they are speaking with an AI (Art. 50 AI Act); the notice also stays visible in the call window throughout. Calls to the customer's own Mira are governed by the data processing agreement, which the customer enters into before the first live launch.
9. Warranty and liability
The statutory warranty rules apply. SPEKTRA is liable for intent and gross negligence. SPEKTRA is not liable for slight negligence — except for personal injury and, towards consumers, damage to items handed over to SPEKTRA for processing. Towards businesses, liability for lost profit and consequential damage is excluded.
10. Right of withdrawal
Consumers have a 14-day right of withdrawal from distance contracts, without giving reasons (§ 11 FAGG). The details are in the withdrawal instructions.
Starting before the period ends: Because building starts immediately, SPEKTRA obtains your express request to begin before the withdrawal period ends (§ 10 FAGG) and your confirmation that the right of withdrawal lapses once the contract has been performed in full (§ 18 (1) 1 FAGG). If you withdraw from a Basic or Standard project while the work is in progress, you pay nothing — that is part of the satisfaction rule (section 3). For Premium, the part already performed is payable (§ 16 (1) FAGG).
Photo shoot: Withdrawal before the shoot is possible at any time within the 14 days, and the amount paid is refunded in full. If the requested date falls within the withdrawal period, SPEKTRA obtains your express request at booking that the shoot should take place before the period ends (§ 10 FAGG); once the shoot has taken place, the right of withdrawal for it lapses (§ 18 (1) 1 FAGG).
Businesses: If you order in the course of your business you are not a consumer within the meaning of the KSchG, and the statutory right of withdrawal does not apply.
10a. Withdrawing a request within six hours
In addition to the statutory right of withdrawal, a project request sent through spektra-sites.com can be withdrawn in your account within six hours, without giving reasons. If you do, no work is started and no cost arises.
This window is an additional offer and does not restrict any statutory right. In particular, the 14-day right of withdrawal for consumers under § 11 FAGG remains untouched.
10b. Our service promise on care plans
For customers on an active care plan: if the site we look after is unreachable for more than 60 consecutive minutes for a reason within SPEKTRA’s control, or if a commissioned change is not carried out on time, your next monthly fee is credited.
The credit arises automatically from our monitoring; you do not have to ask for it, and it appears in your account. It is applied as a discount on your next invoice. At most one credit arises per billing period.
Excluded are outages outside SPEKTRA’s control — in particular disruptions at the hosting provider below the stated duration, failures of the visitor’s own internet connection, blocks imposed by third-party network filters, force majeure, and any period during which the website was paused or taken offline at your request.
11. Consumer dispute resolution
We are neither obliged nor, as a rule, willing to take part in dispute resolution proceedings before a consumer arbitration body. If something is wrong, please come to us first — in our experience that settles almost everything. Regardless, consumers may turn to the Internet Ombudsstelle (ombudsstelle.at) for disputes arising from online transactions.
12. Final provisions
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For consumers, the mandatory consumer protection rules of their country of residence continue to apply.
For disputes with businesses, the competent court at SPEKTRA’s registered office has jurisdiction. For consumers the statutory rules on jurisdiction remain: in particular, a consumer domiciled in Austria may only be sued at their domicile, habitual residence or place of employment (§ 14 KSchG).
If individual provisions are invalid, the remaining provisions stay in force. The statutory rule takes the place of the invalid provision.
For customers on active care plans, these terms may be changed without express consent only where the change (a) is required by statute, regulation or a court or authority decision, (b) is required by changed terms of the hosting, payment or AI providers SPEKTRA uses and does not put the customer in a worse position, or (c) operates solely in the customer's favour. Scope of services, fees, term, cancellation rights, liability and warranty are never changed this way. SPEKTRA emails every change at least four weeks before it takes effect, shows old and new wording side by side, and points out that the change is deemed accepted unless an objection is received before it takes effect, and that the care plan can be cancelled free of charge and without notice until then. All other changes require express consent.
12a. Winter offer 2026
From 26 Sep 2026 to 24 Dec 2026, 23:59 (Vienna time), a limited-time winter price applies, once each, to three add-ons — instead of the price otherwise stated under section 3: AI chatbot € 89 instead of € 149,99, Mira € 109 instead of € 179,99, SEO boost € 99 instead of € 149. The price of the website package itself is unaffected and remains payable in full; the saving applies only to the stated add-on.
The offer applies to one of the three add-ons ordered together with a new website package, as well as to one of these add-ons ordered afterwards for a website SPEKTRA has already built and operates. What matters is when the order is placed: the price that applies at that moment is recorded in the order line and remains binding even if the related payment — the order's final payment, or, for Mira, her activation — takes place after 24 Dec 2026.
For Mira, section 8d also applies: as long as she is marked „in development“ on her product page, the order is a pre-order and can be cancelled free of charge at any time until she is switched on. If ordered before the offer ends, the winter price stated here is charged once she is switched on — regardless of when that activation actually takes place.
The offer can be combined with any referral discount, which applies only to the price of the website package and leaves these add-ons unaffected. Cashing out the benefit of the offer is excluded. The offer will not be extended.
